In a recent order Supreme Court has set aside the order of the High Court whereby quashing of case was rejected. It held that the order was unreasoned and further directed the High Court to decide the petition afresh, and record reasons for its findings.
The Supreme Court Held :
We find that the order dated 13.12.2019 rejecting the quashing petition is unreasoned. We set aside the said Order for this reason and direct the High Court to decide the petition afresh, and record reasons for its findings. S.B.Criminal Misc. Petition No.4909/2019 is restored to the file of the High Court. We request the High Court to decide the case afresh as expeditiously as possible.
