‘Can’t be made to incarcerate in jail for infinity’: Court grants bail to Umar Khalid in Delhi riots case

A Delhi court on Thursday granted bail to former Jawaharlal Nehru University student Umar Khalid in the north-east Delhi violence case. While granting bail to Khalid, the court said that the activist cannot be made to “incarcerate in jail for infinity” merely on account that others who were part of the mob have to be identified and arrested in the matter.

Khalid was arrested by the Delhi Police in October last year in connection with the violence in Khajuri Khas area. Suspended Aam Aadmi Party Councillor Tahir Hussain is also under arrest in the case.

Hussain was taken under arrest by the Delhi Police in September last year and he was charged with the stringent Unlawful Activities (Prevention) Act in a connected Delhi riots case.

It may be recalled that north-east Delhi was hit by communal violence in late February last year in which at least 53 people were killed and around 200 were injured.

Khalid was named in the supplementary chargesheed filed by the Delhi Police in the north-east Delhi violence case in November last year. The supplementary chargesheet dealt with the alleged larger conspiracy part in the riots witnessed in Delhi.

The chargesheet was filed against Khalid, JNU student Sharjeel Imam and one Faizan Khan under the stringent Unlawful Activities (Prevention) Act and sections related to criminal conspiracy, murder, rioting, sedition, unlawful assembly and promoting enmity on the grounds of religion, language, caste, etc of the Indian Penal Code.

The 930-page supplementary chargesheet was filed under sections 13 (unlawful activities), 16 (terrorist act), 17 (raising funds for terrorist act) and 18 (conspiracy) of the UAPA.
